Welcome to Sppero ("Company", "we", "our", "us"). These Terms of Use govern your access to and use of the Sppero mobile application (for customers) and the Sppero Buddy mobile application (for drivers), including any related services, features, and content (collectively, the "Platform"). By downloading, installing, or using our Platform, you agree to be bound by these Terms.
1. Eligibility
To use Sppero, you must:
- Be at least 18 years of age
- Have a valid mobile phone number registered in India
- Have legal capacity to enter into a binding agreement
- Not be barred from using the services under applicable law
For Sppero Buddy (Driver App), additional requirements include a valid Indian driving licence, vehicle registration certificate (RC), insurance, and a vehicle meeting Sppero's vehicle standards.
2. Account Registration
Creating an Account
You may register on Sppero using your mobile phone number, verified via OTP (One-Time Password). You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.
Account Security
You are responsible for maintaining the confidentiality of your account. You agree to immediately notify Sppero of any unauthorized use of your account. Sppero is not liable for any loss resulting from unauthorized use of your account.
One Account Per Person
Each person may hold only one customer account and one driver account. Creating multiple accounts to abuse promotional offers or rewards is prohibited and may result in permanent account suspension.
3. Use of the Platform
Permitted Use
Sppero is designed for legitimate ride-booking and transportation services within India. You agree to use the Platform solely for lawful purposes and in accordance with these Terms.
Prohibited Conduct
You may NOT use the Platform to:
- Book rides for illegal purposes or to transport contraband
- Harass, abuse, or threaten drivers, customers, or Sppero staff
- Provide false information about your location, identity, or ride details
- Manipulate GPS or app functions to defraud drivers or Sppero
- Use automated bots, scripts, or crawlers on the Platform
- Abuse promotional codes, referral systems, or rewards programs
- Reverse engineer, decompile, or attempt to access Sppero's source code
- Engage in any form of discrimination against drivers or customers
4. Rides & Bookings
Standard Rides
When you book a standard ride, Sppero matches you with a nearby available driver. Fare estimates are shown before booking. Final fare may vary based on actual distance, traffic conditions, or surge pricing. You agree to pay the fare displayed at the time of completion.
Hourly Bookings
Hourly bookings allow you to hire a vehicle and driver for a specified number of hours. The driver remains available to you for the booked duration. Extension of bookings requires driver acceptance. Cancellation terms for hourly bookings are stricter — refer to our Cancellation Policy.
Fare Calculations
Fares are calculated based on base fare, per-kilometre rate, time of booking, and applicable surge pricing. Surge pricing activates during peak demand periods and is clearly indicated in the app before booking. By proceeding with a booking during surge, you accept the surge-adjusted fare.
OTP Verification
Each ride requires a 4-digit OTP shared from the customer to the driver to start the trip. This ensures only the correct customer-driver pair can start a ride. Never share your OTP with anyone before the driver physically arrives.
5. Payments
Payment Methods
Sppero accepts the following payment methods: Cash, UPI/direct payment, Sppero Wallet (prepaid balance), and online payments via Razorpay. You agree to pay all applicable fares and fees using the selected payment method.
Sppero Wallet
Sppero Wallet is a prepaid digital wallet within the app. Wallet balance is non-refundable except in cases of account closure at Sppero's discretion. Wallet credits (from rewards, cashback, or referrals) cannot be withdrawn to bank accounts — they may only be used for rides on the platform.
Cashback & Promotions
Promotional cashback, referral rewards, and scratch card rewards are subject to Sppero's reward terms and may be modified or withdrawn at any time. Cashback is credited to Sppero Wallet and cannot be transferred or cashed out.
6. Referral Program
Sppero's referral program allows existing users to invite new users using a unique referral code. Referral rewards are credited to both the referrer and the referred user only after the referred user completes their first ride. Any attempt to game the referral system through fake accounts will result in permanent suspension and forfeiture of all rewards.
7. Driver Terms (Sppero Buddy)
Independent Contractor
Sppero Buddy drivers are independent contractors, not employees of Sppero. Sppero provides a technology platform connecting drivers with customers. Drivers are responsible for their own taxes, vehicle maintenance, fuel, and insurance.
Driver Obligations
- Maintain a valid driving licence and vehicle documents at all times
- Keep the vehicle clean, roadworthy, and insured
- Behave professionally and courteously with all customers
- Follow traffic laws and safety regulations
- Not smoke, consume alcohol, or use a handheld phone while driving
- Accept rides based on fair availability, not on customer identity
Earnings & Payouts
Driver earnings are credited to the Sppero Buddy wallet after each completed trip. Cash commission for cash rides is deducted from payout requests. Payout requests are processed via Razorpay to your registered bank account or UPI ID. Sppero charges a platform commission (disclosed in-app) on each completed ride.
8. Safety
Sppero is committed to the safety of all platform users. Both customers and drivers can:
- Use in-app SOS features for emergencies
- Report unsafe behavior through the complaint system
- Block or report specific users after a ride
Sppero conducts background verification of all drivers including document checks. However, Sppero cannot guarantee the behavior of any individual and encourages users to trust their instincts and prioritize personal safety.
9. Intellectual Property
All content on the Sppero Platform — including but not limited to the app design, logo, trade name "Sppero", features, algorithms, and text — is the exclusive intellectual property of Sppero and its licensors. You may not reproduce, distribute, or create derivative works without express written permission from Sppero.
10. Limitation of Liability
To the maximum extent permitted by law, Sppero's total liability to you for any claim arising from use of the Platform is limited to the amount you paid to Sppero in the 3 months preceding the claim. Sppero is not liable for: indirect, incidental, or consequential damages; losses arising from driver conduct; delays due to traffic or weather; or service interruptions due to technical issues.
11. Indemnification
You agree to indemnify and hold Sppero harmless from any claims, damages, or expenses (including legal fees) arising from your violation of these Terms, your use of the Platform, or your conduct during rides.
12. Termination
Sppero reserves the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, abusive behavior, or any reason at Sppero's sole discretion. Upon termination, your right to use the Platform immediately ceases. Unused wallet balance may be forfeited in cases of fraud or Terms violation.
13. Modifications to Terms
Sppero may update these Terms at any time. We will notify you of material changes through the app or via SMS. Your continued use of the Platform after notification constitutes your acceptance of the updated Terms.
14. Governing Law & Disputes
These Terms are governed by the laws of India. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts in India. Sppero encourages resolving disputes amicably through our support channels before pursuing legal action.
